When it comes to prediction markets and how they're operating throughout the United States, it's safe to say that plenty of issues are being brought up. You can go ahead and add some negative New Mexico betting news to the mix, as headlines are once again being written, but for all the wrong reasons. That's because news has recently broken that New Mexico filed a lawsuit against Kalshi over illegal sports betting.

Yes, per a report, four local tribes have banded together to file a complaint against Kalshi, as they have made it quite clear that online bets are being made on their lands without authorization. The local tribes own the rights to betting in the state, particularly at casinos. However, what we're seeing now goes against those efforts, which is what's being headlined right now. Could changes be on the way?

“Tribes fought hard to protect their inherent sovereign right to operate and regulate casinos on tribal lands," Mescalero Apache Vice President Duane Duffy said in a statement that recently went public. "We cannot sit by idly as the laws that enshrine this right are ignored."

For now, with prediction markets betting good to go at the Federal level, there's nothing that can be done... yet. However, we've seen plenty of states take legal action against these prediction markets. For now, only 33 states have legalized online sports betting, with Wisconsin being the newest one to join the fold. That means double-digit states still haven't legalized things and they're facing the battle against Kalshi and others. This is something New Mexico wants to get corrected.

With that said, that's why New Mexico is prioritizing getting this cleaned up ASAP. The tricky part here is that these kinds of lawsuits take time. Just ask California and Wisconsin about that. Both states also have lawsuits on the table, but not much of anything has come in for positive updates. Instead, there has been more of a waiting game, which has only added confusion and frustration among officials and bettors.

With the prediction markets, futures bets are wide open for the taking, which has led to people continuously checking the NFL sportsbooks for their betting needs. With the Super Bowl recently taking place too, you better believe that people were checking the NFL betting odds consistently and putting money down through Kalshi and others. This of course angered the local tribes in New Mexico, which led to legal action taking place. Now, we must wait to see what ends up happening.

While you only have to be 18 years old to participate in horse racing bets and the state lottery, you indeed have to be 21 for casino betting and in-person sports betting. Because of this, New Mexico is hoping that a Federal judge will see things in the state's favor when it comes to this battle with Kalshi.

It remains to be seen what's going to happen, but again, no decision is expected in the near future. It will be interesting to see what judges decide, but New Mexico certainly has a gripe here. Kalshi being regulated throughout the country is one thing, but if minors under 21 are placing online sports bets, that's definitely a key issue that is being brought up.
